The request proposes vacating a portion of a Sanitary Sewer Easement on Lots 9-13 in Mandalay Plat 1 (previously platted as Outlot X in Berkshire Crossing Plat 1). A Sanitary Sewer Easement was recorded on December 29, 2004. A portion of the Berkshire Crossing development property was incorporated into the boundary of the “Mandalay Plat 1” Final Plat. Recently, a property owner within the Mandalay development inquired about installing a pool. Upon research for the permit application, it was discovered that a portion of the Sanitary Sewer Easement had not been vacated as originally intended when the “Mandalay Plat 1” Final Plat was recorded. This portion of the Sanitary Sewer Easement serves no purpose to the overall sanitary sewer network and no sanitary sewer line was constructed within this easement. The portion of the easement to be vacated has an area of is 12,661 square feet.
